Recording: Uniform Commercial Code in effect. Liens on motor vehicle
must be on title for repossessor.
Recovery: Peaceful repossession permitted.
Repo Redemption: Within 10 days after retaking. If customer had paid 50%
of purchase price or $500.00, a public repossession sale is required. If
less than 50% or $500.00, private repossession sale is permitted.
Deficiency: Suit for balance does not bar retaking and deficiency is
collectible. Confession of judgment notes are valid for repossession.
Special Motor Vehicle Repo Provisions: Lien must appear on title to be
effective for repo as to third parties.
Documents Required to Transfer Ownership of Repo Motor Vehicle:
Repossession Title in debtor's name or lien holder with certified copy
of lien instrument to repossessor. Certificate of registration.
Registration fee: $5.00.
Repossession Plates: Remain with the repo vehicle. (Except for
personalized plates.)
